Terms of Service

In short

you prepay a balance, use it to receive SMS verification codes on temporary numbers, and use those numbers only for legitimate purposes. Orders that never receive a message are refunded automatically. Numbers are temporary and can be reassigned, so don’t rely on them for accounts you need to recover later.

01About these terms

passcode.sh is operated by Variance Ventures LLC, a Delaware limited liability company (“passcode.sh”, “we”, “us”). These Terms of Service govern your use of the passcode.sh website, web app and API (together, the “Service”).

By creating an account or using the Service you agree to these terms, the Acceptable Use Policy, the Refund Policy and the Privacy Policy. If you use the Service for an organization, you accept these terms on its behalf and confirm you’re authorized to do so.

02Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service.

  • Give us an email address you control and keep it current; it’s how we reach you.
  • Keep your password and API keys secret. You’re responsible for activity under your account and keys until you revoke them or tell us they were compromised.
  • One account per person unless we agree otherwise in writing.

While the Service is in early access, account creation may be limited to invited users. Joining the waitlist doesn’t guarantee an account.

03What the Service provides

The Service gives you temporary access to phone numbers so you can receive SMS messages, typically verification codes, from third-party apps and websites:

  • One-time orders assign a number for a limited window (shown before you order). Messages received during the window appear in your console and through the API.
  • Rentals assign a number for 7, 30 or 90 days, with every message it receives delivered to the rental’s inbox.

Numbers are not yours to keep. When an order or rental ends, the number may be assigned to another customer after a cooldown period. Do not use a number for an account you’ll need to verify or recover again later.

We don’t control third-party services. They decide whether to send a message to a number and whether to accept it, and they can change those rules at any time. Stock, success rates and delivery times shown in quotes are estimates from recent activity, not guarantees.

Inventory labelled “Demo inventory” is simulated for testing: the numbers are fictional and the messages are generated by our simulator, not sent by any third party.

04Balance, prices and payments

The Service runs on a prepaid balance in US dollars. You add funds by card through our payment processor, Stripe, and orders and rentals are paid from that balance at the price shown before you confirm.

  • Your balance is not a bank or deposit account, earns no interest, and can’t be transferred to another account.
  • Prices can change for future orders. A price change never affects an order you’ve already placed.
  • You’re responsible for any taxes that apply to your purchases, other than taxes on our income.
  • If a payment is reversed or disputed, we may deduct the amount from your balance and suspend the account until it’s resolved.

05Refunds

Orders that don’t receive a message are refunded to your balance automatically, and orders cancelled before a message arrives are refunded in full. Once a message arrives, the order is final. The Refund Policy sets out every case, including rentals and unused balance.

06Acceptable use

You must follow the Acceptable Use Policy, which is part of these terms. Among other things it prohibits fraud, account takeover, impersonation, harassment and spam, and using the Service to verify financial, government or healthcare services.

07API and automation

You may use the API with keys created in your account. We apply rate limits and may change them to protect the Service. Don’t attempt to get around rate limits, access the Service other than through the web app and the documented API, or interfere with its security or other customers’ use.

Webhooks are sent to the URL you configure and signed so you can verify they came from us. You’re responsible for securing your endpoint.

08Messages we receive for you

We store the content of messages sent to numbers you order or rent so we can show them to you and keep the Service working, as described in the Privacy Policy. Treat codes as sensitive: anyone with access to your account or API keys can read them.

09Suspension and termination

We may suspend or close an account, cancel active orders or rentals, or refuse service if we reasonably believe the account breaks these terms or the Acceptable Use Policy, creates risk for us, our carriers or others, or if the law requires it. Where it’s safe and lawful, we’ll tell you why.

You can close your account at any time by emailing support@passcode.sh. What happens to any remaining balance is covered by the Refund Policy.

10Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that any particular third party will send or accept a message, or that the Service will be uninterrupted or error-free.

11Limitation of liability

To the fullest extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the three months before the claim arose and US$50.

12Indemnity

You agree to defend and indemnify Variance Ventures LLC against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Service or your breach of these terms or the Acceptable Use Policy.

13Changes to these terms

We may update these terms. For material changes we’ll give notice by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.

14Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction, and you and we consent to them.
